In Virginia, emotional support animals may be used by anyone who suffers from a mental or emotional disability. In order to protect those who use emotional support animals as an important part of their mental health treatment plans, the state works to maintain caring laws and practices.
According to Virginia's Fair Housing Act (FHA), landlords must provide reasonable accommodations for any tenants who can show a valid ESA letter as proof and who have an emotional support animal. This means that regardless of the landlord's customary pet policy or limitations, they are not permitted to impose any additional fees or breed or weight limits on the animal.
A landlord may only lawfully refuse a renter with an ESA if the animal directly endangers the safety of others or significantly devalues the property or rental unit.
